Justice Sandeep Marne, in a single-judge bench, held that although the volunteers are designated as 'swayamsevaks,' their functions align with those of municipal employees because they perform public health duties, maintain attendance, work fixed hours, and follow medical staff instructions. ^[1] The Bombay High Court dismissed all petitions filed by the Brihanmumbai Municipal Corporation (BMC) on August 14, 2026, against an order that recognized community health volunteers as workers eligible for minimum wages under the Minimum Wages Act, 1948. ^[2] Residents of the Cuffe Parade area in South Mumbai submitted a petition to the Mumbai Traffic Police Department and the Brihanmumbai Municipal Corporation (BMC) seeking traffic management and a 'zero-tolerance silence zone' around the GD Somani School. ^[3] The BMC challenged the September 7, 2020 order of the Assistant Labour Commissioner (Mumbai), arguing that no employer-employee relationship exists and that the term 'honorarium' exempts the volunteers from the Minimum Wages Act. ^[4] The court stated that describing the volunteers' payment as an 'honorarium' does not exclude them from the purview of the Minimum Wages Act and that they are entitled to the notified minimum wage applicable to the employment category under the Act. ^[5] Laura D'Souza reported that the constant traffic results in honking all the time, creating a very noisy environment in the Cuffe Parade locality. ^[6] Laura D'Souza, a resident of Cuffe Parade, stated that the road in front of the GD Somani School is very narrow and experiences constant traffic throughout the day due to school buses and private vehicles dropping off children. ^[7]
