A pension reform in Colombia, which modifies the retirement system, includes provisions effective next April regarding the inheritance of pensions. ^[1] After receiving approval from the Constitutional Court, the reform maintains the inheritance of pensions as a benefit for contributors and their families. ^[2] The Colombian Constitutional Court ordered a pension administrator to deliver survivor pension payments directly to the maternal grandmother of two minors. ^[3] For the mandatory component, accumulated balances pass to the inheritance mass and can be delivered to heirs up to the fourth degree of consanguinity if no legal beneficiaries with survivorship rights exist. ^[4] In the absence of primary beneficiaries, the right extends to economically dependent parents or siblings with disabilities. ^[5] The Colombian Constitutional Court established that when protective measures exist and a person effectively cares for minor beneficiaries, entities must analyze real circumstances to avoid blocking access to resources. ^[6] The court found that the grandmother had effectively assumed the maintenance, attention, and integral care of the minors, a situation confirmed by provisional custody granted by family authorities. ^[7] The court ruled that the grandmother's fundamental rights were violated because the administrator prioritized formal legal interpretations over the reality that she provided material care and held provisional custody. ^[8]
