District Judge Deborah Boardman in Maryland issued a preliminary injunction on Wednesday blocking President Donald Trump's new executive order regarding birthright citizenship. ^[1] The Supreme Court ruled six to three in June that birthright citizenship was protected under the Fourteenth Amendment of the Constitution in the case Barbara v Trump. ^[2] Judge Boardman ruled that Executive Order 14418 is likely unconstitutional because it contradicts the protections established by the Fourteenth Amendment. ^[3] Judge Deborah Boardman stated that the new executive order is almost certainly unconstitutional because the Supreme Court in Barbara already decided that the children in the certified class are citizens at birth. ^[4] The order sought to deny citizenship to children of foreign nationals in certain groups, including those accused of engaging in a commercial transaction to obtain citizenship or classified as an 'alien enemy'. ^[5] Executive Order 14418, signed on August 6, 2026, proposed exceptions to birthright citizenship for children of parents with ties to terrorist organizations, foreign governments, or commercial birth tourism. ^[6] The lawsuit challenging the order was filed by organizations including CASA Inc. and the Asylum Seeker Advocacy Project (ASAP) on behalf of children born in the US after February 19, 2025, to mothers without documentation or with temporary status. ^[7]
