Federal Judge Deborah Boardman issued a preliminary injunction on a Wednesday to temporarily block the application of Donald Trump's new executive order regarding birthright citizenship in the United States. ^[1] Judge Deborah Boardman ruled that the new policy is likely unconstitutional with respect to minors protected by the collective lawsuit. ^[2] Judge Deborah Boardman ruled that the 2026 Executive Order is almost certainly unconstitutional as applied to the certified class because the Supreme Court in Trump v. Barbara already decided that the children in the class are citizens at birth. ^[3] The executive order sought to establish restrictions for specific children born in the United States whose parents are foreign nationals, including cases related to 'birth tourism'. ^[4] The new executive order was signed by Donald Trump on August 6, 2025, following a Supreme Court rejection of his previous attempt to limit birthright citizenship. ^[5] The new executive order targets four specific groups: children of alien enemies defined by terrorism designations, children of foreign government employees or international organization employees, children of parents engaging in birth tourism, and children born in US territories where citizenship is not conferred by statute. ^[6] The Supreme Court majority in Trump v. Barbara made clear that the phrase 'subject to the jurisdiction thereof' in the Fourteenth Amendment includes children of all persons who are subject to and required to obey US law. ^[7]
