Judge Tony Graf is expected to rule at a 10 a.m. hearing in Provo, Utah, on whether Tyler Robinson, 23, will stand trial for the murder of Charlie Kirk and whether prosecutors may seek the death penalty. ^[1] Prosecutors have accused former electrical apprentice Tyler Robinson of firing the single shot that killed Charlie Kirk, 31, during a debate with students at Utah Valley University in Orem on September 10, 2025. ^[2] Tyler Robinson is charged with aggravated murder for allegedly endangering the lives of others at the event, a charge that carries the death penalty in Utah. ^[3] A Utah judge will decide on Tuesday if there is enough evidence to put Tyler Robinson on trial for aggravated murder, which would make him eligible for the death penalty. ^[4] Defense lawyers have said there is no evidence Robinson disagreed with Kirk's political views. ^[5] Prosecutors argued that numerous people were within a 'zone of danger' around Kirk when he was shot from a rooftop more than 122 metres away. ^[6] Prosecutors in July spent five days presenting what they said was 'overwhelming' evidence that Tyler Robinson killed Charlie Kirk while he was speaking at an open-air event on a college campus. ^[7] The 23-year-old defendant turned himself in a day after the shooting at Utah Valley University last September and has not yet entered a plea. ^[8] Robinson's lawyers questioned the prosecution's DNA testing and stated that police failed to investigate evidence suggesting someone else might have carried out the killing. ^[9]
